Rep Power: 100796 | Woman Sues Maker of Louisville Slugger and Sporting Good Store Her son (age 12) was hit in the chest by a line drive from the bat and suffered brain damage. Now she's sueing the maker of the bat and the sporting good store saying they knew the bat was dangerous to children when they sold it.
Are we going to have future generations playing ball with plastic bats and wiffle balls??? Had this been a wooden bat, she would have still complained that her son might have gotten a splinter.
How do you play baseball without hitting the ball?? Isn't that the whole purpose??
OMG!!! how in the world would you not know there were dangers with SPORTS OF ANY KIND!!! Obviously she knew there was a potential for an injury with a ball flying around at sometimes 100 mph...
Did they not sign a waiver upon registration? They knew the risks but signed up anyway... It's not like there's anyone in the world who hasn't atleast SEEN baseball being played. Quote:
Article: FOXNews.com - Family Files Lawsuit in Metal Baseball Bat Injury Case - Local News | News Articles | National News | US News
WAYNE, N.J. — The family of a boy who suffered brain damage after he was struck by a line drive off an aluminum baseball bat sued the bat's maker and others on Monday, saying they should have known it was dangerous.
The family of Steven Domalewski, who was 12 when he was struck by the ball in 2006, filed the lawsuit in state Superior Court. It names Hillerich & Bradsby Co., maker of the 31-inch, 19-ounce Louisville Slugger TPX Platinum bat used when Steven was hit.
The lawsuit also names Little League Baseball and Sports Authority, which sold the bat. It claims the defendants knew, or should have known, that the bat was dangerous for children to use, according to the family's attorney, Ernest Fronzuto. Steven was pitching in a Police Athletic League game when he was hit just above the heart by a line drive. His heart stopped beating and his brain was deprived of oxygen for 15 to 20 minutes, according to his doctors. | (response to bold part) I've seen many, many pitchers now wearing helmets and chest gear, why didn't he? |

Rep Power: 101102 | Re: Woman Sues Maker of Louisville Slugger and Sporting Good Store Thats ridiculous to sue a maker of a bat! They need to change rules to the point its a wooden bat league only. College baseball is ridiculous, and for that matter slow pitch softball is just plain silly. Bats are getting hotter and hotter all the time. I play softball on a very high level and the times I have seen pitchers get hit with liners back at em is countless. It can be controlled in something like slow pitch softball, but in a sport like baseball its uncontrollable. Its horrible what happened to the child, but why the hell are they trying to make a quick buck off the poor kid! |

The family is pathetic I feel horrible for the kid but they should not win this case at all. But, there have been some ridiculous cases like the one where the women spilled coffee on herself and claimed she didn't know it was hot. |

Well most of us were already blasting them but I know exactly what you're talking about with the bats. The metal bats are just crazy. |

She should sue the company that made his cleets because he they didn't help him get out of the way in time. Also the company that made that batters batting gloves, they helped him grip the bat better.
Might as well sue the parents of the kid who hit that ball to, if they would have never had a child this would have never happend |

Sad about the kid tho, no one likes to see that type of thing happen |

its sad about the kid but it was a freak accident and she should be mourning the loss of her child rather than the makers of a bat.
but why not sue the kid while she is at it? he didnt hit the ball so he is a much responsible? or the pitcher for actually throwing the ball to hard? |
